Action to be taken as Tribunal challenges Gov Okpebholo’s election victory

Governor Monday Okpebholo and the All Progressives Congress (APC) have secured a victory in the first round of petitions challenging their declaration as winners of the September 21, 2024, governorship election in Edo State.

The Edo State Governorship Election Petition Tribunal dismissed a petition filed by the Action Alliance (AA) and Adekunle Rufai Omoaje, ruling it to be without merit and frivolous.

In the Tribunal’s first ruling on Wednesday, it was determined that Omoaje, the petitioner, lacked the legal standing to file the case, as his petition did not concern election-related issues.

The Tribunal further explained that Omoaje had not participated in the governorship election and, therefore, had no right to challenge its validity.

Additionally, the Tribunal pointed out that Omoaje’s complaint was about not being recognized as the National Chairman of the Action Alliance for the purpose of nominating candidates. However, the Tribunal found that his grievance had no legal foundation under the Electoral Act of 2022.

In his petition, Omoaje sought to have the declaration of Okpebholo and the APC as winners of the election by the Independent National Electoral Commission (INEC) declared illegal, unlawful, and void due to alleged violations of the Electoral Act.

He also accused Okpebholo and the APC of winning the election through corruption and without obtaining the majority of lawful votes.

Moreover, Omoaje claimed that AA was prevented from nominating a valid governorship candidate because he was not recognized as the National Chairman to sign the nomination forms.

INEC had previously announced Okpebholo of the APC as the winner with 291,667 votes, defeating Asue Ighodalo of the Peoples Democratic Party (PDP), who received 247,655 votes.
