Court to hear Nnamdi Kanu’s motion seeking transfer to National Hospital

The Federal High Court is scheduled to hear a motion on Monday filed by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), seeking to be moved to the National Hospital in Abuja for urgent medical treatment.

Justice Musa Liman had earlier approved an ex parte request, allowing the matter to be heard during the court’s vacation period due to its urgent nature.

The judge fixed the hearing for September 15 and directed Kanu’s counsel, Uchenna Njoku, SAN, to serve all related documents and hearing notices on the Department of State Services (DSS), so they can respond accordingly.

“I believe that the right to health is as important as the right to life. And so I agree that this matter can be heard by the vacation court,” Justice Liman, serving as a vacation judge, stated.

As reported by the News Agency of Nigeria (NAN), Kanu filed the motion with suit number FHC/ABJ/CR/383/2015, requesting that his main application dated September 1, 2025, be heard during the court recess.

The motion, filed on September 3 by Chief Kanu Agabi, SAN, presented 11 reasons justifying the urgent hearing. Agabi pointed out that Kanu is currently facing trial before Justice James Omotosho in the same case.

Agabi reminded the court that on May 19, his client applied for bail while awaiting the trial on terrorism-related charges. However, the bail application was not addressed before the court went on recess, leaving Kanu in continued custody.

He explained that during this period, Kanu’s health worsened significantly, prompting the need for a detailed medical evaluation. Doctors who examined him reportedly identified several concerning issues affecting vital organs such as the pancreas and liver, along with an unusual lump under his armpit and critically low potassium levels.

Medical experts recommended immediate transfer to the National Hospital to provide the necessary care and prevent further deterioration.

Agabi emphasized that the nature of Kanu’s confinement is aggravating his health challenges, making it essential for the court to urgently hear the motion.

He also disclosed that a medical report advising Kanu’s relocation had been sent to the DSS Director-General but has received no response to date.

The application, he argued, was a necessary step to prevent a potential medical crisis, while legal efforts are underway to facilitate his treatment.

Agabi further assured the court that granting the motion would not negatively impact the DSS or the case in any way, noting that the court has full jurisdiction to rule on the matter.

In a sworn affidavit, Emmanuel Kanu, the younger brother of the IPOB leader, stated that Kanu recently reported feeling weak and in pain. This prompted the involvement of a medical team led by Eminent Emeritus Professor Austin A.C. Agaji, who visited him on September 1 around 2:30 p.m.

According to Emmanuel, the doctors had conducted tests in August, which confirmed that Kanu was suffering from serious issues with his liver and kidneys, as well as dangerously low potassium levels.

“He was further diagnosed of a swelling around his armpit area which requires urgent attention to ascertain the cause and thereafter to seek appropriate medical treatment,” he averred.
