Lateef Fagbemi, the Attorney General and Minister of Justice of the Federation, has come under fire from the Peoples Democratic Party (PDP) in Osun State for allegedly abusing his position and being overly powerful.
The party also disclosed that the theory of separation of powers was being dangerously undermined by Fagbemi’s actions over the seizure of state allocations.
President Bola Tinubu was urged to restrain Fagbemi and remind him that everyone is subject to the law.
The Osun PDP denounced the interference in the obstruction of local government councils as politically motivated in a statement released Monday by Olaleke Bamiji, the party’s media director.
The statement reads, “The act, ex facie, is not only ultra vires but also a subversion of the rule of law. Nemo judex in causa sua-no one should be a judge in his own cause. Mr Fagbemi, having previously served as lead counsel to Mr. Gboyega Oyetola, a principal actor in Osun APC, ought to recuse himself from any matter directly or indirectly affecting the political ecosystem of the State, and allow the law courts to decide as appropriate.”
The party accused Fagbemi of using his position to undermine the impartiality that the country’s chief law officer is supposed to possess.
The party said, “The recent directive, lacking any known judicial backing, which halted the disbursement of funds to democratically elected local governments in Osun State, is a clear affront to constitutionalism and the principles of audi alteram partem-the right to a fair hearing.
“No court has issued any pronouncement to warrant such fiscal strangulation. This is not only an illegality but a calculated attempt to undermine good governance in Osun State.”
Regardless of party affiliation, the party urged Fagbemi to put justice and equity for all Nigerians above his own interests and political views.
Additionally, it remembered that Fagbemi’s admonition to the Osun State Independent Electoral Commission (OSSIEC) not to hold elections for local governments was unfounded.
The Osun State All Progressives Congress, or APC, responded to the statement by urging the public to disregard the PDP’s claim of the confiscated local government funds.
The Osun APC is asserting that the Appeal Court in Akure has reinstated its council officials who won the October 15, 2022, local government election held during the final days of the Adegboyega Oyetola administration, while the PDP is asserting that its candidates won the February 22, 2025, local government polls.
