For the horrific murder of Hafsat Aliyu, a married lady in Niger State, two sisters, Amina Aliyu and Aishat Mohammed Aliyu, have been found guilty and condemned to death by hanging.
Because of her age at the time of the crime, a third sibling, Zainab, was spared the death penalty and given a life sentence.
The family home in Barkin Saleh, Minna, was the scene of the crime in March 2021.
Court documents state that Aishat used a pestle to attack Hafsat, Amina Aliyu’s co-wife, before setting her body on fire in the kitchen.
Alhaji Muhammad Sani, Hafsat’s husband, was one of the main witnesses at the trial.
After starting at Minna Chief Magistrate Court Number One, the trial was later moved to the High Court. Sani was one of four witnesses who provided testimony that supported the prosecution’s case for more than three years.
“The punishment for culpable homicide under Section 221 of the Penal Code is death,” said Justice Balkisu Gambo Yusuf of Minna High Court 7 in his ruling.
Citing Zainab’s position as a minor at the time of the offence, defence attorney Peter Omale begged for clemency.
“As of 2021, when the offence was committed, the Administration of Criminal Justice Act (ACJA) excluded anyone below 18 from facing the death penalty,” Justice Yusuf noted in acknowledgement of this. As a result, Zainab received a life sentence.
