On Monday, December 16, the Supreme Court will decide President Bola Tinubu’s case in a new lawsuit that aims to have him removed from office as Nigeria’s leader.
The current lawsuit, SC/CV/667/2023, asks the supreme court to remove Tinubu from office on two main grounds: he is allegedly unable to serve as Nigeria’s president and he usurped the position in violation of national law.
Chief Ambrose Albert Owuru, who ran for president in 2019 on the platform of the HDP and Hope Democratic Party, filed the new lawsuit directly with the Supreme Court.
Former President Muhammadu Buhari, the Attorney General of the Federation, and Tinubu, the Minister of Justice for the Independent National Electoral Commission (INEC), are the first and fourth defendants in the case, respectively.
Owuru, a lawyer with British training who was admitted to the Nigerian Bar in 1982, is adamant that he won the 2019 presidential election but that Buhari seized his position for eight years.
He asserted that the Supreme Court had officially dismissed his lawsuit, which would have removed Buhari from office, since the hearing dates had been mixed up.
However, he urged that Tinubu be disqualified by the Supreme Court due to the forfeiture of $460,000 to the United States of America for alleged involvement in an offence relating to drug trafficking.
The former presidential candidate, in addition to accusing Tinubu of forfeiting the money in connection with drug trafficking, said Tinubu was an active CIA agent, a position that, he claimed, forbids Tinubu from serving as Nigeria’s president.
In an attempt to regain his usurped mandate, Owuru is requesting that the Supreme Court declare him the winner of the 2019 presidential election and order his immediate inauguration after Tinubu was disqualified for serving as Nigeria’s president.
In the meantime, the Supreme Court has scheduled a definitive hearing on the case for Monday, December 16.
“Please kindly take note that the hearing of Motions in SC/CV/667/2023 Chief Ambrose Albert Owuru & Anor VS President Muhammadu Buhari & 3 Ors at the Supreme Court of Nigeria sitting in Abuja is scheduled for Monday, 16/12/2024,” said the hearing notice for the new complaint.
“Thanks, Ukor Michael Akan, for: the Hon. Chief Registrar.”
According to ZINGTIE, Tinubu received the hearing notice via the Minster of Justice and the Office of the Attorney General of the Federation.
Chief Wole Olanipekun, SAN, may represent Tinubu in the lawsuit on Monday, according to information obtained.
ZINGTIE further reminded that Owuru had previously been fined N40 million by the Court of Appeal for bringing a baseless lawsuit against Tinubu, INEC, and others.
Before Owuru filed the latest lawsuit, our correspondent was unable to determine whether the fine had been paid.
