Lawyer files contempt charge against IGP Egbetokun over alleged violation of court order

Yahuza Maharaz, a legal practitioner based in Abuja, has initiated contempt proceedings against the Inspector General of Police, Kayode Egbetokun, citing failure to adhere to a court ruling.

The legal action also includes Alhaji Isah Yusuf-Musa and two other parties as respondents in the contempt filing.

Justice M.A. Madugu of the Bwari Division of the FCT High Court had, on June 25, 2025, granted an interim order instructing the police and other involved parties to preserve the current state of affairs concerning a legal dispute brought forward by Maharaz on behalf of Pamodi Pharmacy, an Abuja-based business.

The case, filed under suit number HC/BW/CV/199/2025, revolves around a disagreement over a lease involving Pamodi Pharmacy, situated in Hillcrest Shopping Complex, Lokogoma, Abuja, and Alhaji Yusuf-Musa.

Listed as the first to fourth defendants in the case are Yusuf-Musa, Hillcrest Estate Management Development, the Nigeria Police Force, and the IGP.

In the June 25, 2025 ruling on the application with motion No: FCT/HC/M/8303/2025, Justice Madugu said, “Upon reading the Motion Ex parte along with the accompanying affidavit of Pharm. Abugi Abdulkadir Mohammed, including the written address and the exhibits filed along with the application.

“And upon hearing Yahuza Maharaz Esq. counsel to the Claimants/Applicants, Court hereby makes the following order(s), “The parties herein shall maintain the status quo in respect of the subject matter of this suit i.e. an office space measured at 160 square metres, situated at Hillcrest shopping complex/mall, lying and situated at Plot No. 102. Cadastral Zone C09. Ahmadu Bello Way. Lokogoma, Abuja FCT.

“This order shall be pasted on the main entrance gate and or walls of Hillcrest shopping Complex/Mall.”

The matter was scheduled to continue on October 22, 2025.

Despite this directive, the claimant alleged that the pharmacy’s electricity and water supply were deliberately cut off, reportedly on the instructions of Yusuf-Musa, in defiance of the court’s ruling.

It was also claimed that the posted court order was unlawfully removed from the premises in contradiction of the judge’s directive.

Furthermore, Maharaz accused the police of escalating the situation by summoning the managing director of Pamodi Pharmacy, which he considers a direct violation of the court’s order.

The message reads, “I’m Detective Ibrahim from Zone 7 Police Headquarters, Wuse Zone 3, FCT. As a matter of utmost importance, the Assistant Inspector General Zone 7 Police Headquarters directs you to avail yourself for an interview with the AIG through the O/C Surveillance on Friday, 11/7/2025, at 10:00 hours unfailingly in respect of a petition written to the AIG. Treat with utmost importance. Accept the regards of the AIG, please.”

As a result of these developments, the claimant proceeded to file contempt charges against the IGP on July 8.

A formal notice was issued to warn all defendants, including the police chief, to obey the existing court order or face contempt sanctions. This included instructions to restore power and water to the pharmacy immediately and cease any further police intimidation or summons directed at the business.

Copies of the contempt notice were also sent to relevant authorities including the National Security Adviser, Nuhu Ribadu; the Economic and Financial Crimes Commission (EFCC); the Independent Corrupt Practices Commission (ICPC); and the Department of State Services (DSS).

The claimant emphasized that the issue at hand is civil in nature, and criticized the police for interfering in a matter outside their legal jurisdiction.
