Ondo man gets death sentence for killing roommate during brawl

An Ondo State High Court has condemned a middle-aged man named Sunday Omoniyi to death by hanging for fatally stabbing his roommate during a fight.

Accused of killing Michael Oyebanji following a fight over shutting the door, Omoniyi was charged with one count of murder.

Inspector Fisayo Oladepo, the police prosecutor, stated that the offense was punished under Section 319 of the Criminal Code, Cap 37, Vol. 1, Laws of Ondo State of Nigeria 2006, and that it violated Section 316.

The event happened on July 23, 2022, at around 6:30 am, according to prosecution witness Ismaila Adefaka, who told the court that the deceased and the defendant were both his tenants at 4, Canaanland, Ijoka road, Akure, the state capital.

According to Adefaka, he hurried to the defendant’s apartment when the event happened and saw Omoniyi in a pool of blood after the defendant had stabbed him in the chest with a knife.

The landlord insisted that the victim was declared dead after being taken to the hospital; this led him to report the incident to the police station, which resulted in Oyebanji’s arrest.

Additionally, the court was informed by Adedugbe Opeyemi, Adedeji Gift, and Aremu Opeyemi—co-occupants of both the dead and the defendant—that the deceased and the defendant had a disagreement earlier that morning regarding a door, but that it had been settled in their favor.

The witnesses stated that they hurried back into the room after hearing the deceased’s cry in agony, only to find him lying on the floor in a pool of blood and the defendant holding a blood-stained knife.

Adedugbe Opeyemi claims that the defendant admitted to stabbing the deceased in reprisal for the late Oyebanjil striking him with his fist.

According to Justice W.R. Olamide’s ruling, the prosecution established the defendant’s guilt of murder and sentenced him to death by hanging after the police prosecutor told the court that Omoniyi had confessed to the crime in a statement.
