Again, court stops PDP from holding 2025 convention, INEC from recognizing outcome

The People’s Democratic Party (PDP) has been barred from hosting its 2025 National Convention, which was supposed to take place in Ibadan, Oyo State, between November 15 and 16, by a Federal High Court in Abuja for the second time.

Additionally, the court prohibited INEC, the Independent National Electoral Commission, from overseeing, keeping an eye on, or acknowledging the results of the National Convention, which is where national officials are supposed to be chosen.

The new order was made by Justice Peter Odo Lifu on Tuesday while rendering a decision in an application filed by Sule Lamido, a former governor of Jigawa state.

Lamido, a PDP foundation member, filed a lawsuit against the party, claiming that he was not given the chance to purchase a chairmanship nomination form so that he may attend the convention.

The judge based the limitation order against PDP on the party’s refusal, disregard, and noncompliance with pertinent rules and regulations governing the conduct of such conventions.

The judge concluded that Lamido’s testimony demonstrated that the convention schedule was not made available to members as required by law.

Because Lamido would suffer more if he were permitted to be illegally excluded from the upcoming convention, Justice Lifu further concluded that the balance of convenience favored Lamido.

In order to provide a remedy, the judge stated that the former governor had promised to compensate PDP in the event that his lawsuit was determined to be baseless.

The judge stated that people in authority must strictly adhere to due process in a constitutional setting, adding that doing otherwise would jeopardize democracy itself.

In accordance with section 6 of the 1999 Constitution, he added, a court of law cannot renounce its duty to administer justice without fear or favor.

According to Justice Lifu, if the court renounces its constitutionally mandated duties, chaos would reign at all times and places.

In his final ruling, the judge prohibited PDP from holding the convention scheduled for November 15 and 16 or at any other time in Ibadan.

Additionally, he prevented INEC from overseeing, tracking, or acknowledging the results of any convention that the PDP could hold.

Recall that on October 31, James Omotosho, another judge of the same court, issued similar directives prohibiting INEC from overseeing or acknowledging the convention’s results, should it be held.

His argument was based on the reality that the convention’s planning did not adhere to due process.

Additionally, according to Omotosho, the PDP neglected to provide the required 21-day notice of meetings and congresses so that INEC could fulfill its mandatory responsibility of keeping an eye on them.

After ruling that the PDP’s noncompliance with the law has jeopardized the planned convention, Justice Omotosho advised the party to take the appropriate steps before holding the poll.

As a result, he prohibited INEC from accepting, disseminating, or acknowledging the results of the convention scheduled for Ibadan until the law was followed.
