Court nullifies Ekiti PDP LG congress, upholds ward executives

The Peoples Democratic Party (PDP) local government congress in May 2025 was declared unlawful by an Ekiti State High Court in Ado-Ekiti.

The court affirmed the March 15, 2025, ward congress, which resulted in the appointment of new party executives for each of the 177 wards in the state, in its decision on Friday.

In her ruling, Justice Bamidele Omotosho emphasized that “no suit based on a charlatan claim must be acted upon by the court,” citing well-established legal standards.

The court recognized the claimant as the legitimately chosen chairman and delegate of Ward 1, Ado-Ekiti Local Government, in accordance with the PDP’s 2024 standards for convention conduct, among other rulings, based on uncontested affidavits and the evidence presented to it.

Additionally, Justice Omotosho ruled that the defendants’ delegate list to various party organs was “invalid” due to violations of the Nigerian Constitution, the PDP Constitution (as amended), and the Electoral Act 2022. A permanent injunction prohibiting the defendants and their representatives from identifying or utilizing the contested list of delegates was also imposed by the court.

The judge cautioned all parties to abide by the court’s rulings, abstain from self-help, and not challenge the judiciary’s authority. Actions taken against the 177 ward congresses in contravention of previous restraining orders were deemed disrespectful and were subsequently revoked.

PDP chieftain Funsho Ayeni responded favorably to the ruling, calling it an opportunity for party members to unite.

“This ruling provides an opportunity for reconciliation and unity. Leaders must work together to strengthen the PDP ahead of the June 20, 2026, governorship election and ensure victory over the APC,” Ayeni said.
