Court orders British Airways to pay Nigerian passenger N53m for breach of contract

The Federal High Court in Lagos has ordered British Airways to pay N50 million in damages to Nigerian passenger Mr. Stephen Osho for breach of contract and unfair treatment.

Justice Ibrahim Kala ruled that Osho suffered unnecessary hardship, inconvenience, and financial losses due to the airline’s negligence.

Additionally, the court awarded N3 million to cover litigation expenses, including legal fees, summons charges, and other costs related to the lengthy case, as well as losses from naira depreciation, bringing the total compensation to N53 million.

The judge found that Osho proved the airline breached its duties under the international contract of carriage when it failed to deliver his checked baggage on Flight BA307 from Paris to London on December 2, 2022.

British Airways, in its defense, claimed that Osho was responsible for his situation and asked the court to dismiss the case. The airline’s lawyer also argued that any awarded costs should not exceed N60.

However, the court rejected this argument, describing it as unfounded and contrary to the evidence presented.
