Enemona Anyebe is prohibited from posing as the head of the state’s opposition Peoples Democratic Party, or PDP, by a Kogi State High Court in Lokoja.
In suit number HC/Okp/8/2024, which was filed by John Ojodale against the PDP and another, Justice Yahaya Adamu of the State High Court 5, Lokoja, gave the ruling on Tuesday. Since Enemona Anyebe was deemed unable to run, the court mandated a new election within 45 days to fill the Chairmanship vacancy.
According to Justice Adamu’s decision, Anyebe was not a candidate at the PDP Congress on August 31, 2024, because he was allegedly suspended from the party.
Hon. Muhammad Sani Gambo, the first runner-up at the Kogi State PDP Congress on August 31, 2024, responded to the court’s decision by arguing that he is still the party’s legitimately elected chairman.
Gambo claimed that he was the main winner of the decision since it stated that Enemona Anyebe was not allowed to run for office rather than nullifying the election.
He did, however, object to the court’s order for a new election to be held within 45 days, claiming that the prayer for a new election was not part of the original summons and that it was thus contempt.
“Our case is before the Federal High Court. We are going to appeal the section of the ruling where the judge ordered a fresh election within 45 days,” he said.
“This was not part of the plaintiff’s originating summons, and we were not even party to the suit filed at the State High Court.”
Gambo added that he wasn’t named chairman in part because he wasn’t a party to the lawsuit. He disclosed that he has filed an appeal with the Federal High Court in Lokoja, seeking a declaration that he is the rightful winner of the election.
He urged his followers and the state’s PDP members to maintain their composure, promising that the Federal High Court would take the necessary action and deem him the legitimately elected state PDP chairman.
