“Elections are won by party, not candidate” – Femi Falana fumes

Femi Falana, a well-known human rights attorney, has called on the Independent National Electoral Commission (INEC) to reevaluate holding by-elections due to the needless expense.

Falana maintained that political parties, not specific candidates, should receive the votes voted in elections

He believes that the political party that supported the candidate should just select a replacement in the event of an elected official’s death or resignation, obviating the necessity for an expensive electoral procedure.

He stated, “The political parties that sponsored the candidates that die or resign should be directed to fill the vacancy by nominating another candidate.”

In addition, Falana demanded that the Electoral Act be changed to let political parties to take the place of elected public officials who are removed from office by “death, resignation, or impeachment.”

He noted, “By virtue of Section 221 of the Nigerian Constitution, elections are won by political parties and not by candidates.”

Falana backed up his claim with prior court rulings, such as “Amaechi vs. INEC & Ors (2008).”

He also brought up the case of “PDP v. INEC (1999),” in which Mr. Boni Haruna was permitted to take over as governor of Adamawa State after Atiku Abubakar, the elected governor, resigned.
