The Peoples Democratic Party (PDP) has filed legal action at the Federal High Court in Abuja, seeking the removal of four National Assembly members from Osun State following their defection to the All Progressives Congress (APC).
The lawmakers named in the suit are Senator Francis Adenigba Fadahunsi (representing Osun East), Senator Olubiyi Oluwole Fadeyi (Osun Central), Hon. Omirin Emmanuel Olusanya (Atakumosa East/West and Ilesa East/West Federal Constituency), and Hon. Taofeek Abimbola Ajilesoro (Ife Central/East/North and South Federal Constituency).
In the four individual suits filed on Wednesday by Raphael Oyewole, the party’s lead counsel, each legislator is listed as the first defendant. In cases involving the senators, the Senate President is named as the second defendant, while the Speaker of the House of Representatives is cited in those involving the House members. The National Assembly, Clerk of the National Assembly, and the Independent National Electoral Commission (INEC) are included as the third to fifth defendants in all filings.
The PDP’s argument centers on Section 68(1)(g) of the 1999 Constitution (as amended), which stipulates that a lawmaker who defects from the party through which they were elected without any proven division, merger, or faction automatically forfeits their seat.
The party is urging the court to affirm that the continued presence of the four lawmakers in office, following their switch from PDP to APC, breaches constitutional provisions and effectively nullifies their positions.
Among the reliefs being sought, the PDP is asking the court for:
- A mandamus order compelling Senate President Godswill Akpabio and House Speaker Tajudeen Abbas to officially declare the seats vacant;
- A directive instructing INEC to organize bye-elections to fill the now-vacant legislative positions;
- An order halting the disbursement of salaries, benefits, and other entitlements to the defected lawmakers;
- A reimbursement of all financial compensation received by the legislators from the date of defection until the court’s final verdict.
The party maintains that granting these requests would serve to uphold the constitutional mandate in Section 68(1)(g) and (2) and restore legislative integrity.
The suits were filed under the following case numbers:
FHC/ABJ/CS/1725/2025,
FHC/ABJ/CS/1728/2025,
FHC/ABJ/CS/1727/2025, and
FHC/ABJ/CS/1726/2025,
targeting Fadahunsi, Fadeyi, Olusanya, and Ajilesoro respectively.
