According to the law, the president of the Federal Republic of Nigeria has the authority to declare a state of emergency in any state.

Section 305 of the 1999 Constitution (as modified) states as much.

The declaration was made by Tinubu on Tuesday, March 18, 2025, on a national broadcast.

According to Vanguard, the following procedures must be followed in order to declare a state of emergency:

The declaration must be approved by the National Assembly (Senate and House of Representatives) within two days if it is in session or ten days if it is not.

Rivers State House of Assembly members and Governor Siminalayi Fubara were suspended by President Tinubu for a period of six months.

Tinubu stated that the good people of Rivers State benefited from his actions.

The administration is too hurried to adopt a stance, according to Joseph Johnson, commissioner of information and communications.

“The president has made a declaration and what do you think we can say? I think it is too hasty to make any comment about it.”
