The petition of Patrick Tonye-Cole, the All Progressives Congress (APC) candidate for governor of Rivers State in the 2023 general elections, against the Independent National Electoral Commission (INEC), Governor Siminalayi Fubara, and the Peoples Democratic Party (PDP) will be heard by the Supreme Court in Abuja on January 15, 2024.
Tonye-Cole’s pleas include the court’s suggestion that Fubara be removed from office as governor for his refusal to step down as the state’s accountant general after winning the PDP candidature in the previous election.
Additionally, Tonye-Cole has maintained that Fubara was not eligible to run in the previous election, much less be proclaimed the victor.
In addition, the APC candidate for governor is requesting that the court declare him the election winner or invalidate polls in a few local government districts due to purported irregularities.
Tonye-Cole’s lawsuit was rejected by the tribunal due to a lack of merit on all counts; however, it was successful on some counts at the Court of Appeal before being heard by the Supreme Court.
