Supreme Court reserves judgment on Rivers guber appeal

The Supreme Court postponed ruling on Monday in the appeal brought by Patrick Tonye-Cole, the All Progressives Congress (APC) candidate for governor of Rivers State, against Siminalayi Fubara’s win in the most recent gubernatorial contest.

Tonye-Cole has filed an appeal against Fubara, the Peoples Democratic Party (PDP), and the Independent National Electoral Commission (INEC).

The Appeal Court’s ruling on November 28th, which rejected Tonye-Cole’s appeal due to a lack of substantial and persuasive evidence, set the stage for this case.

The APC candidate for governor is citing noncompliance with the Electoral Act and Fubara’s continuous signature on documents in his capacity as Rivers State’s accountant general following his nomination by the People’s Democratic Party (PDP) as justification for the appeal.

After all parties to the lawsuit adopted their briefs of arguments, a five-member panel led by Justice Kudirat Kekere-Ekun decided to hold off on deciding the appeal.
