On Wednesday, a group of 12 U.S. states took legal action against the administration of President Donald Trump, contesting the legality of the tariffs he has enacted. The states argue that the president does not have the authority to implement such measures without Congressional approval.

Arizona Attorney General Kris Mayes, in a public statement, criticized the tariff plan as both economically irresponsible and outside the bounds of the law.

Arizona is one of several states participating in the legal challenge, alongside Democratic-led states such as Minnesota, New York, and Oregon.

California launched a similar legal complaint just one week earlier.

Trump’s trade moves during his second term have disrupted financial markets, marking a sharp departure from longstanding free trade policies. His “Liberation Day” declarations introduced a wave of new tariffs targeting various countries.

Among the most significant of these is a 145 percent import tax on goods from China. In response, China hit back with its own tariffs, raising duties by 125 percent on American products.

Speaking to the press on Wednesday, the president said he is seeking a balanced agreement with China. He also confirmed the imposition of 10 percent tariffs on other global trading partners and warned of further trade penalties to come.

The coalition of states claims that the 1977 law used by Trump to justify the tariffs does not authorize him to apply emergency powers in this context. They argue that the authority to regulate trade and impose tariffs lies solely with Congress, as outlined in the U.S. Constitution.

“By claiming the authority to impose immense and ever-changing tariffs on whatever goods entering the United States he chooses, for whatever reason he finds convenient to declare an emergency, the President has upended the constitutional order and brought chaos to the American economy,” the lawsuit alleged.
