Babagana Mingali, a forensic analyst, testified in the Abuja Division of the Federal High Court that no nude photos were found on the mobile phones belonging to Cyril Ndifon, the dean of the Faculty of Law at the University of Calabar. Mingali, a second defence witness, works at the laboratory of the Office of the National Security Adviser (ONSA).
Mingali analysed the mobile phones and wrote a report, which was presented to the court on August 8, 2024. Justice Omotosho admitted the report as an exhibit in the case. Mingali explained that his office used professional tools to extract documents from the phone, saying, “My lord, we used the universal forensic extraction device, a touch tool, and some accompanied Cable 2070 and Cable 100, including some external storage devices, in trying to extract the data.”
When asked if he found any nude photographs, email trails, voice recordings, text messages, or conversations on the phones, Mingali replied, “I did not find any.” He also stated that no relevant information was found on the phones between January 2021 and January 2024, due to the outdated WhatsApp application.
Mingali noted that updating the WhatsApp application could potentially reveal relevant information. He also mentioned that officials from other agencies, including the ICPC, work in the NSA lab.
During cross-examination, Mingali said he had practiced forensic analysis for about five years. He acknowledged that the police, the Economic and Financial Crimes Commission, and the ICPC have forensic labs. Mingali also admitted that the ICPC used the same device (touch tool) used by his office to generate Exhibit H images from the professor’s mobile phone.
The judge adjourned the matter until April 3 for continuation of defence.
