Victoria Island Property: Court Makes Fresh Order As Dispute Deepens

The Federal High Court sitting in Lagos has issued an interim injunction stopping Levitikal Realties & Construction Limited from selling, transferring, mortgaging, leasing, assigning or otherwise dealing with a disputed property at No. 68 Molade Okoya Thomas Street, off Ajose Adeogun Street, Victoria Island, Lagos.

The order was issued by Justice A. Lewis-Allagoa in Suit No. FHC/LAG/CS/1245/2026 following an application brought by Dr. (Mrs.) Maryam Sani Abacha against Levitikal Realties & Construction Limited.

The court further ordered that the property must not be handled in any way that could affect or undermine the outcome of the ongoing proceedings.

The property in dispute is covered by a Certificate of Occupancy dated July 4, 1988, and registered as No. 32 at Page 32 in Volume 1988B of the Lands Registry Office, Lagos State.

The ruling followed a Motion Ex Parte dated September 9, 2026, and filed on September 10, through which the applicant requested several interim orders pending the determination of a Motion on Notice seeking an interlocutory injunction.

Among the reliefs sought, the applicant asked the court to prevent Levitikal, its directors, officers, agents, representatives, assigns and other persons acting on its behalf from selling, transferring, mortgaging, charging, leasing, alienating or encumbering the property.

The applicant also sought an order stopping the company from presenting itself to third parties as the owner of the property with the authority to sell, transfer or otherwise encumber it.

In its ruling, the court granted an interim injunction restraining the defendant from taking any action or carrying out any act intended to interfere with, overreach, dissipate, assign, transfer, sell, alienate, encumber or otherwise prejudice the subject matter of the suit pending the hearing and determination of the Motion on Notice.

The court specifically barred Levitikal from selling, assigning, transferring, mortgaging, charging, leasing, alienating, encumbering, granting possession of or otherwise creating any interest in the Victoria Island property, except pursuant to an order of the court.

The court also granted permission for the applicant to publish the orders in national newspapers and online media platforms circulating within Nigeria.

The publication is aimed at informing members of the public, prospective buyers, lenders, investors and other interested parties about the pending litigation and the applicant’s claimed interest in the property.

The court further directed the Nigeria Police Force, the Inspector-General of Police, the Assistant Inspector-General of Police, Zone 2, the Commissioner of Police, Lagos State, the Economic and Financial Crimes Commission and other relevant law enforcement agencies, where necessary, to provide security and assistance towards the execution and enforcement of the orders.

The dispute followed disagreements between the parties concerning the property and a Joint Venture arrangement for its development.

Court documents relied upon by the applicant showed that a Notice of Dispute and Request for Mediation and/or Arbitration dated September 7, 2026, had been issued in connection with the matter.

The applicant maintained that the dispute had led to court proceedings and arbitration over the property.

In the proceedings, Levitikal Realties & Construction Limited was listed as the defendant/respondent, while Dr. (Mrs.) Maryam Sani Abacha was named as the plaintiff/applicant.

The property had also previously been linked to an investigation by the EFCC, based on materials presented by the applicant.

However, the Federal High Court’s September 29 order in the present case represents a separate judicial development arising from the dispute between the parties over the property.

The interim orders have placed restrictions on transactions and other dealings involving the property pending the continuation of the case.

The matter was adjourned until November 9, 2026, for further proceedings.
