Wike vs Fubara: Court rules in favour of Tinubu

A lawsuit contesting the legality of President Bola Tinubu’s involvement in the state’s political crises has been dismissed by the Rivers State High Court in Port Harcourt.

Ten representatives of the state’s sons and daughters, led by His Highness Anabs Sara-Igbe, filed the lawsuit against President Tinubu, the Governor of Rivers State, Siminalayi Fubara, the Speaker of the Rivers State House of Assembly, Martin Amaewhule, and the Peoples Democratic Party, PDP. The lawsuit was rejected for lack of jurisdiction.

The plaintiffs wanted to know if the peace accord’s instructions to overcome the state’s political deadlock were compliant with the 1999 Constitution as amended, as well as whether they were a constitutional interpretation of the agreement.

The legality of the President’s order to the governor to re-present the 2024 budget to the members of the House of Assembly, led by Martin Amaewhule, even after their seats were declared vacant, was another question they wanted answers to.

The applicants also insisted on knowing if it was appropriate to resubmit for screening the names of commissioners who had voluntarily resigned from their positions.

They requested that the court decide if Amaewhule’s 24 House of Assembly colleagues, who left the PDP to join the All Progressives Congress (APC), were entitled to continue serving in the house.

Nevertheless, Justice Chinwendu Nworgu, the sitting judge, dismissed all petitions and denied jurisdiction to hear the lawsuit when it came up for hearing on Tuesday.

Nworgu cited the ruling of the Abuja High Court’s James Omotosho, which declared the actions of the Rivers State House of Assembly faction led by Edison Ehie to be void.
