Appeal court affirms Julius Abure, LP’s National Chairman

Julius Abure, the national chairman of the Labour Party (LP), has been upheld by an appeal court.

“Barr Julius Abure remains the LP National Chairman, Appeal Court Rules,” stated a social media post on the Labour Party’s X account.

The development was confirmed by a brief phone call to Obiora Ifoh, the Party’s Publicity Secretary.

The ruling is the result of appeals submitted by the Independent National Electoral Commission, or INEC, and the caretaker committee of the Labour Party, which is headed by Senator Esther Nenadi Usman.

Abure is the legitimate leader of the party, according to a Federal High Court ruling that preceded the most recent ruling.

However, the party’s caretaker committee took Abure to the Appeal Court in response to the ruling.

Abure is the acknowledged national chairman of the Labour Party, according to a three-member panel of the appellate court’s decision rendered on Friday by Justice Hamma Barka.

The court claims that its November 13, 2024, ruling, which had previously acknowledged Abure as the national chairman, is still in effect and has not been overturned by any other court.

The appeal court, however, ruled that since matters of this nature are not subject to the rule of law, it did not examine the matter of the Labour Party’s leadership.

According to the court, any action taken outside of its jurisdiction is null and void. Therefore, the Federal High Court’s October 8, 2024, ruling by Justice Emeka Nwite is null and void because it was delivered without jurisdiction.

“We cannot say this appeal fails or succeed because the lower court lacked jurisdiction to entertain the suit in the first place”, Barka held.

He ruled that the appeal court had relied on its earlier ruling from November 13 of last year to find that “Abure Remains National Chairman of the Labour Party” when dismissing the claim for lack of jurisdiction.
