Court gives fresh order for recall process against senator Natasha Akpoti-Uduaghan

An earlier ruling prohibiting the Independent National Electoral Commission (INEC) from handling the recall case against Senator Natasha Akpoti-Uduaghan has been overturned by a Federal High Court in Lokoja, Kogi State.

The court confirmed in a historic decision on Friday that the recall process started by Kogi Central Senatorial District residents is legally sound and consistent with their civic rights. It called on the people to peacefully and equitably exercise their rights.

This comes after INEC was temporarily barred from receiving, accepting, or acting upon the recall petition by a previous interim injunction that was issued on Thursday. Additionally, until a related motion was decided, the injunction prohibited the electoral authority from holding any referendums based on the petition.

Anebe Jacob Ogirima and four other Kogi Central registered voters filed an ex-parte application backed by an affidavit of exceptional urgency, and the injunction was granted. The recall petition’s veracity was questioned by their attorney, Smart Nwachimere, who claimed that it had fake signatures.

However, the court upheld its opposition to the use of phony signatures, preventing INEC from taking any action regarding recall petitions that contained false entries.

The case has been postponed for additional proceedings until May 6, 2025.
