Court sets 26 suspects free over lack of diligent prosecution

A Chief Magistrate Court in Minna has discharged and acquitted 26 individuals who were facing charges of criminal conspiracy and being part of a gang of thieves.

The suspects were initially charged by the Niger State Police Command in October 2024 for offenses punishable under sections 97 and 306 of the penal code.

However, the prosecution failed to move forward with the case, leading the defense team to request the court to release the defendants.

The defense, led by Barrister Abubakar Sadiq Ma’aji, argued for the discharge of the defendants due to “lack of diligent prosecution.”

As a result, the Presiding Chief Magistrate, Hajiya Ummul Katume Mohammed, discharged the 26 defendants, referencing Section 191 of the Administration of Criminal Justice Act Law (ACJA) of Niger State, 2021.
