EFCC an unlawful organisation – Ex-NBA president, Agbakoba writes Nigerian Senate

According to Mr. Olisa Agbakoba, SAN, a former president of the Nigerian Bar Association (NBA), the Economic and Financial Crimes Commission (EFCC) is an illegal body.

Agbakoba made this claim in two different letters to the Senate and the House of Representatives on October 14. On Wednesday, newsmen in Abuja were given access to a certified accurate copy of the letters.

The two letters were sent individually to Mr Benjamin Kalu, the deputy speaker of the house, and Senator Barau Jibrin, the deputy president of the Senate.

In their respective capacities, the two served as the Senate and House Committees on Constitution Review’s chairs.

According to the senior attorney, he firmly feels that the EFCC was “unconstitutionally established.”

He brought constitutional concerns about the nation’s law enforcement forces and obstacles to the government’s goal of eradicating corruption—as outlined in Section 13 of the 1999 Constitution—to the National Assembly’s notice.

“I very strongly believe the EFCC is unconstitutionally established.

“The powers under which it was established go beyond the powers of the National Assembly.

“The EFCC is an unlawful organisation,” Agbakoba, a former President of NBA, said.

“This will put to rest the question relating to the validity of the EFCC,” he said, adding that he was happy to see that numerous states have finally decided to contest the EFCC’s constitutionality.

The letter to the Deputy Senate President is titled, “Urgent Legislative Attention on Constitutional Reforms Relating to Law Enforcement Agencies and Anti-Corruption Efforts”.
