Rivers Assembly: What you should know as court decides on Labour Party’s suit against Amaewhule, 26 others

A lawsuit brought by the Labour Party in Rivers State against the purported defection of Martin Amaewhule, the suspended Speaker of the Rivers State House of Assembly, and twenty-six other people was dismissed by a Federal High Court in Port Harcourt.

Justice Emmanuel Obile highlighted a recent Supreme Court ruling in his Tuesday ruling, stating that it had previously handled the defection issue brought up in the lawsuit.

The judge ruled that he lacked the authority to make a decision on an issue that the supreme court had already decided definitively.

In his final written speech, the defendants’ attorney, Senior Advocate of Nigeria, SAN Ken Njemanze, requested the court to dismiss the complaint because the Supreme Court’s decision affirmed the lawmakers’ validity.

Clifford Chuku, the Labour Party’s counsel, countered that the defection issue was a side issue in the Supreme Court’s decision and urged the court to keep the lawsuit.
