Rivers: Fubara thinks he’s above constitution – Amaewhule after enacting 3 laws without gov’s consent

The crisis in Rivers State appears to have no end in sight, as the House of Assembly, led by Speaker Martins Amaewhule, passed three bills without Governor Sim Fubara’s assent.

The three laws were passed by the Amaewhule-led Assembly without consulting Fubara.

The factional Speaker claimed during plenary that Fubara believes he is above the Nigerian constitution.

The Rivers State Commissions of Inquiry Bill 2024, the Rivers Electricity Market Bill, and the Rivers State Education (Return of Schools) (Amendment) Bill are the bills in question.

The lawmakers claimed that their acts were in the best interests of the Rivers people and in accordance with Section 100(5) of the Federal Republic of Nigeria, 1999, as amended Constitution. They also maintained that their activities advanced legislative positivism.

The lawmakers had previously approved the three legislation and forwarded them to Fubara for his signature.

Following Fubara’s decision to withhold his assent, the lawmakers reportedly followed legislative procedures to make the laws of Rivers, according to a statement confirmed by Martins Wachukwu, Amaewhule’s Special Assistant, Media.

Members debated the proposals when Major Jack, the House’s Majority Leader, re-presented them, the statement said.

When the governor refused to provide his assent, Amaewhule pointed to Section 100(5) of the Federal Republic of Nigeria, 1999 Constitution as the enabling clause that gave the House the authority to overrule him.

He insisted that the state must advance and underlined that the governor could not stop it as “a result of his indolence and ineptitude”

Amaewhule described Fubara “as one who sees himself as above the Constitution of the Federal Republic of Nigeria, the judiciary and other extant laws of the state.”
