Due to an All Progressives Congress (APC) lawsuit that is scheduled to appear in the Supreme Court on Tuesday, January 14, 2025, the hearing of petitions filed by the Peoples Democratic Party (PDP) and its candidate, Asue Ighodalo, contesting the announcement of Governor Monday Okpebholo as the winner of the Edo State governorship election was postponed Monday.
When the pre-hearing and scheduling reports were presented to the parties and solicitors in Benin City on December 21, 2024, the three-member tribunal led by Justice Wilfred Kpochi postponed the hearing of the petitions until January 13, 2025, according to ZINGTIE.
Upon the petition’s Monday hearing, the tribunal was informed that the APC and the Independent National Electoral Commission, or INEC, had submitted a motion for adjournment to enable them to attend to a case at the Supreme Court.
Informing the court that the application was from the first respondent, INEC, and the second respondent, APC, the assistant secretary to the tribunal, Dayo Dahunsi, asked that the sitting be postponed till Wednesday, January 15, 2025.
According to Dahunsi, the application was prepared on the premise that the two applicants’ lead solicitors would appear before the Supreme Court on Tuesday in a case scheduled for a set hearing.
According to him, the petitioners claimed that their requests related to other tribunal petitions against their clients.
In the spirit of collaboration, Ken Mozia, SAN, the petitioner’s reacting lawyer, stated that he had nothing against the application.
Oladipo Oshinowo, Mozia’s attorney, stated that the petitioners’ lead attorney obtained a copy of the motion seeking for adjournment late from the court’s registry.
While stating that they were ready to start the trial on Monday, the Senior Advocate of Nigeria also stated that they were forced to grant the respondents’ request for an adjournment.
However, he asserted that the undertaking would prevent the respondents from making such a request for adjournment in the future.
Justice Wilfred Kpochi, the tribunal’s chairman, postponed all petitions until Wednesday, January 15, 2025, after granting the respondents’ application.
ZINGTIE recalls that on September 22, 2024, the Independent National Electoral Commission proclaimed APC candidate Senator Monday Okpebholo the election’s victor.
Asue Ighodalo of the PDP, Okpebholo’s closest opponent, received 247,274 votes, while Okpebholo received 291,667.
