A body that was mistakenly buried in Fadiya, Zangon Kataf LGA, Kaduna State, has been ordered to be unearthed and given a proper burial in accordance with Bajju tradition and custom by an Upper Customary Court in Kaduna.

A lengthy family quarrel that resulted in the deceased’s body remaining unburied for a long time was caused by a disagreement among the children of the late Mrs. Cecilia Peter Kabruk regarding her final resting place.

In his ruling, Douglas Danladi, the presiding judge of the Television Judicial Division of the Kaduna State upper customary court, indicated that the body of the late Mrs. Cecilia, who was mistakenly buried, would be unearthed and given to the family’s elders for a befitting burial.

In addition, the magistrate granted N2.5 million to unlock the house in Fadiya, Zangon Kataf, so that the body could be exhumed and the old grace could be filled.

The judgment creditors of Emmanuel Bakam Peter and Sama’ila Bakam, represented by Barr. James Bala Ndam, clarified that they had previously prevailed in the case against the opposing party, which included Hajiya Maryam Doka, Maureen Kabruk, Dud Peter, George Peter, and Pascalina Bakam, at both the Upper Customary Court and the Customary Court of Appeal.

Ndam clarified that the opposing party filed an appeal against the rulings following two rulings. He claimed that although they also submitted a counter-affidavit to the Court of Appeal, the other party violated the court’s instructions and buried the late Mrs. Cecilia Peter Kabruk before the suit’s hearing.

He clarified that in the judgments rendered on September 19, 2024, and February 6, 2025, he had sought for an order that would sentence the respondents to prison for breaking the court’s directives.
