The Federal High Court in Abuja has rejected a no-case submission filed by former Kaduna State Governor, Malam Nasir El-Rufai.
El-Rufai is facing trial over allegations that he unlawfully intercepted the telephone communications of National Security Adviser, Nuhu Ribadu.
In a ruling delivered on Monday, Justice Joyce Abdulmalik held that the Department of State Services (DSS) had presented sufficient evidence to compel the former governor to defend himself.
The judge consequently directed El-Rufai, who is the only defendant in the case, to begin presenting his defence.
Through his lawyer, Akinyemi Aremu, El-Rufai had argued that the prosecution failed to establish a case against him after the DSS concluded its presentation with two witnesses.
However, DSS counsel, Oluwole Aladedoye, SAN, maintained that the defence had failed to address Exhibit “B”, which allegedly contained El-Rufai’s admission that he tapped Ribadu’s phone.
