The United States Supreme Court has dealt a significant setback to President Donald Trump by rejecting his attempt to restrict birthright citizenship, dismissing one of his most controversial immigration policies.

In a 6-3 ruling delivered on Tuesday, the apex court invalidated an executive order signed by Trump that sought to limit the automatic granting of US citizenship to individuals born on American soil.

Birthright citizenship is guaranteed under the 14th Amendment to the United States Constitution, which provides that every person born or naturalised in the country is entitled to citizenship. However, Trump moved to challenge that constitutional protection on the first day of his second term in office.

“Citizenship, then and now, was the right to have rights — to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land’. We keep that promise today,” Chief Justice John Roberts said.

Before the Supreme Court’s intervention, lower federal courts had already suspended the implementation of Trump’s executive order while the legal challenge was being considered.

Relations between Trump and the Supreme Court have reportedly become increasingly strained following previous rulings against his administration, including a decision concerning tariff policies.

Although Trump appointed three of the court’s nine justices during his presidency, the Republican leader has repeatedly criticised the court in recent months and had publicly predicted that the justices would rule against him on the birthright citizenship issue.
