The 2024 ward and local government area congresses held by the Peoples Democratic Party (PDP) in Abia State were declared invalid by the Abia State High Court, which is seated in Bende and is presided over by Justice C.U. Okorafor.
Additionally, the Court declared the PDP’s Abia State councillorship and chairmanship primaries for the state’s local government election on November 2, 2024, to be invalid.
The decision came after a lawsuit filed by Enyinnaya Ogbu, a PDP leader.
The PDP, the PDP National Chairman, the PDP National Financial Secretary, the PDP National Organizing Secretary, the PDP National Legal Adviser, the PDP National Secretary, Kenneth Madubuike, Allwel Asiforo Okereke, and the Abia State Independent Electoral Commission, or ABSIEC, were named as defendants in the case designated HB/5/2024.
The claimant had payed for reliefs “A declaration that the conduct of ward and Local Government congresses, primary elections to nominate the PDP chairmanship and councillorship candidates for the Abia State Local Government Election, 2024 and/or the nomination and submission of list of candidates and all communications made thereto by the 7th and 8th Defendants and their cohorts to the 9th Defendant at the behest of the 1st -6th Defendants constitute clear negation and violation of the orders of the High Court of Abia State.”
Francis Etuzu & 2 Ors. V. PDP & 4 Ors, dated 23/7/2024 and 25/10/2024, respectively, was the suit number he cited, HB/3/2024.
All of the claimant’s pleas were answered by the presiding judge, Hon. Justice C. U. Okorafor, when he rendered his decision.
Mr. O. O. Amuzie, the claimant’s counsel, praised the decision in his post-judgment remarks, calling it a victory for democracy, justice, and equity.
However, PDP attorney Ukpai Ukairo stated that his client would file an appeal following appropriate discussions with the party’s pertinent institutions.
In addition to expressing hope for a favorable ruling at the Appeal Court, Ukairo stated that he will request a delay of the judgment’s execution, pointing out that congresses are party internal matters that are outside the purview of the courts.
